Child Support Modification Requests Explained

Child support is not a one-and-done order. The number set at the time of a divorce or custody case is based on the financial picture at that moment, and that picture changes. Parents lose jobs. Parents get raises. Kids grow up and have new costs. Custody arrangements shift. When those changes happen, the support order can be revised through a modification request. This is how that process works.

When a Modification Is on the Table

California allows either parent to ask for a change to a child support order if there has been a change in circumstances since the original order was entered. The change has to be substantial. A small bump in income or a minor schedule shift usually does not qualify. The kinds of changes that do qualify include a significant change in either parent’s income, up or down. A change in the custody or visitation schedule that gives one parent more or less time with the child. A change in the child’s needs, like medical conditions or educational requirements that were not present before. A change in the cost of child care. The birth of additional children to either parent, which can affect the calculation.

The court does not require a specific dollar amount of change. It looks at the overall picture. A parent who lost a job and is now collecting unemployment will usually have a strong case for reduction. A parent who got a promotion and a substantial raise will likely face an increase request from the other side.

The Calculation

California uses a statewide formula for Child Support Modification. The formula takes into account both parents’ incomes, the time each parent has the child, tax filing status, deductions for health insurance and certain other items, and the number of children. The formula is run through a software program in most counties, often DissoMaster or X-Spouse, which produces a guideline number.

Judges almost always order the guideline amount unless one side gives a strong reason to go higher or lower. The Process

The steps look a lot like the original support case.

Filing the Motion

The parent asking for the change files a Request for Order with the court. The form asks what is being requested and why. A supporting declaration explains the change in circumstances. A new Income and Expense Declaration goes with it, along with recent pay stubs and tax returns.

Serving the Other Parent

The other parent has to be served with the paperwork. They get a chance to file a response. The response will usually include their own Income and Expense Declaration so the court has both sides of the financial picture.

The Hearing

A hearing is set, often a few weeks to a few months out depending on the court calendar. Both parents appear, the judge looks at the numbers, and a new order is entered. If the parents reach an agreement before the hearing, they can submit a stipulation and skip the appearance.

Retroactive Effect

A modification can only go back to the date the request was filed. Not the date the change in circumstances happened. This matters because parents sometimes wait too long. A parent who loses a job in January but does not file the modification until June will only get the lower support amount starting in June. The five months of higher support owed before the filing date still has to be paid. Filing quickly after a change saves money.

What Does Not Count as a Change

Some things do not count as a basis for modification. A parent’s voluntary unemployment or underemployment, for example. If a parent quits a good job to take a lower-paying one without a strong reason, the court can impute income based on what the parent should be earning. The same applies to a parent who refuses to look for work after a layoff.

Remarriage of either parent does not automatically change the support calculation, though the new spouse’s income can be considered in limited ways for tax purposes. The arrival of new children to either parent does affect the formula, but only modestly.

A few situations come up often enough to talk about specifically.

Job Loss

Job loss is one of the most common reasons for modification. The parent who lost the job files quickly to lower the support amount. The court will usually adjust based on unemployment income. Once the parent finds new work, the support amount can be adjusted again to match the new income. The earlier the filing, the less back-support builds up at the higher rate.

Custody Shift

If the parenting time changes significantly, the support number should change too. A parent who now has the child sixty percent of the time instead of forty percent will see the calculation shift. Parents sometimes work out a custody change informally and forget to update the support order. That can cause problems if the parent paying support keeps paying the original amount when the time-share is different.

A Child Turning Eighteen

Child support in California generally ends when the child turns eighteen, or nineteen if the child is still in high school full time and living with a parent. If there are multiple children on one order, the order needs to be recalculated when one child ages out. The remaining support amount usually goes down, but not by the full per-child share, because the formula adjusts based on the total number of children covered.

A Parent Moving Out of State

If one parent moves out of California, the question of which state has jurisdiction over the order can get tangled. Most of the time, California keeps jurisdiction as long as one parent or the child still lives in the state. If everyone leaves California, the order may need to be registered in the new state before any changes can be made.

Child support is not meant to be set in stone. The law expects circumstances to change and provides a way to adjust the order when they do.
